RSL Queensland Veteran & Family Wellbeing Network Portal Terms of Use
Welcome to the Veteran & Family Wellbeing Network Portal (Network Portal). Permission to use the Network Portal is conditional upon the user of the Network Portal (you or your) agreeing to the terms set out below. You must read and accept these terms of use in order to use the Network Portal (Terms of Use). By clicking “I Agree”, you will be deemed to have accepted the Terms of Use. If you do not wish to accept the terms, you must not click “I Agree” and you may not use the Network Portal.
1. Acting on behalf of an organisation
To use the portal to access data relating to, or to conduct a transaction for your organisation
- your organisation must be part of the Veteran & Family Wellbeing Network (Network Partner);
- you must be currently appointed by that organisation to access that data or conduct that transaction on their behalf; and
- if that appointment is based on you holding a certain position within your organisation, you must currently hold that position.
2. Your obligations
You must comply with the following obligations:
- only use the Network Portal for your organisation’s lawful purposes in accordance with these Terms of Use, and in a manner that does not infringe the intellectual property rights of or restrict or inhibit the use and enjoyment of the Network Portal by any third party;
- you remain solely responsible for complying with all applicable laws in connection to your use of the Network Portal. It is your responsibility to check that storage of, transfer and access to the materials you transmit or input via the Network Portal will comply with all laws applicable to you;
- keep your username and password absolutely confidential, not disclose your username or password to anyone and you must not allow anyone to access the Network Portal using your username and password for any reason;
- act responsibly to maintain the security and integrity of the Network Portal, so as to minimise the chance of any problems or security breaches;
- safeguard and maintain the confidentiality, integrity, and availability of any information contained within the Network Portal that you use, disclose, and/or access at all times, regardless of how it was accessed;
- not attempt to undermine the security or integrity of the Network Portal;
- not attempt to gain unauthorised access to any materials other than those to which you have been given access to as a user of the Network Portal;
- not in any way divulge, copy, reproduce, adapt, release, sell, loan, alter, or destroy any information contained within the Network Portal, except as properly authorised;
- immediately report to RSL Queensland any activity that violates this agreement, relevant privacy laws, or any other incident that could have any adverse impact on the Content or the Network Portal, including if your password has been seen, disclosed, or otherwise compromised; and
- continue to maintain the confidentiality and integrity of all Content and the Portal even after termination, completion, cancellation, expiration, or cessation of access to the Network Portal.
3. Intellectual Property
- RSL Queensland retains all right, title and interest, including all intellectual property rights in and to the Network Portal. The Network Portal must only be used or dealt with by you as provided for in this agreement. All rights not specifically granted in these Terms of Use are reserved by RSL Queensland.
- You must not use any intellectual property on Network Portal for any other purpose without express permission from RSL Queensland.
4. Collections Notice
- In order to provide you with access to the Network Portal, RSL Queensland are collecting your personal information, such as your name, contact details and organisation.
- We will be using this information to create your user account, monitor and report on the usage of the Network Portal, as well as communicate with you on Network Portal interactions as required.
- Collection of your personal information is necessary for us to provide you with access to the Network Portal. We will be unable to provide you with access to the Networkl Portal if you do not provide this information.
- Information about how to access, correct or have us delete your personal information or how to make a complaint about our handling of your personal information can be found in our privacy policy at https://rslqld.org/about-us/privacy-policy.
- This website may also use small data files called cookies on your computer. For more details about how RSL Queensland uses cookies please refer to our privacy policy.
5. Disclaimer
You acknowledge that:
- you agree that material you transmit or input via the Network Portal may be accessed by other users who are permitted access to the material by RSL Queensland. Therefore, you should consider and assess the risk of which users will have access to material you transmit or input via the Network Portal before using the Network Portal;
- the information included in the Network Portal may include the views or recommendations of third parties and does not necessarily reflect the views of the RSL Queensland or indicate endorsement of a particular course of action;
- the Network Portal does not in any way constitute any form of medical, psychological, legal, financial or healthcare advice or any other form of professional advice and will not be used by you as a substitute for professional advice and/or information;
- RSL Queensland makes no representations or warranties with respect to the accuracy, reliability, sufficiency or completeness of the information contained within the VFWN Portal and, to the extent permitted by law, specifically disclaim any implied warranties or merchantability or fitness for any particular purpose; and
- you indemnify RSL Queensland for any loss or damage it suffers in connection with your use of the Network Portal. Your liability to indemnify RSL Queensland under these Terms of Use will be reduced proportionately to the extent that any negligent or other tortious act or omission of the RSL Queensland contributed to the relevant loss or damage.
6. No copies
You must not make any copies of the VFWN Portal or any information contained therein, in whole or in part in any form (including printing or screenshotting) unless in accordance with these Terms of Use without the express written consent of RSL Queensland (given at RSL Queensland’s absolute discretion).
7. Termination
If you:
- breach any of these Terms of Use or conditions posted by RSL Queensland on the Network Portal;
- no longer appointed by an organisation to access the Network Portal; or
- are engaging in fraudulent immoral or illegal activities or
- if the Organisation you are representing on the Network Portal is offboarded as a Network Partner.
RSL Queensland may, without limiting its rights, terminate your access to the Network Portal or suspend for any period of time your use of the Network Portal.
8. Waiver
Failure or neglect by either party to enforce at any time any of the provisions of this agreement will not be construed or deemed to be a waiver of that party's rights under this licence.
9. Governing law
This licence will be governed by and construed according to the law of the Queensland, Australia and the parties irrevocably submitted to the non-exclusive jurisdiction of the Courts of Queensland.
10. Changes to these terms
We may change the terms of this agreement from time to time. You can either:
- accept these changes by continuing to use the Network Portal; or
- if you do not accept the changes, you have a right to withdraw from the Network Portal and/or terminate this agreement by written notice to us.
